I-9 Compliance Alert: New Form I-9 Released, Employers Must Meet Deadline For Compliance

U.S. Citizenship and Immigration Services (USCIS) officially released the new version of Form I-9 today.  Employers can continue to use the previous version (Rev. 11/14/2016) through September 17, 2017.  After that date, all previous versions of Form I-9 will be invalid.

The changes include revisions to both the Form I-9 instructions and to the list of acceptable documents.  A summary of the changes are available below, while more details are in the USCIS announcement:

Revisions to Form I-9 instructions:

  • The Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC) changed to its new name Immigrant and Employee Rights Section (IER)
  • The words “the end of” have been removed from the phrase “the first day of employment”

Revisions related to the list of acceptable documents include:

  • Consular Report of Birth Abroad (Form FS-240) has been added to List C
  • Combined all certifications of report birth issued by the Department of State into selection C #2 in List C
  • All List C documents have been renumbered, except the Social Security card

Bottom Line

While the changes may seem minor, it’s important that employers get the new Form in place to meet the September deadline.  Additionally, it’s critical that employers and their Section 2 completers understand the new acceptable documentation options for Form I-9.
