U.S. Citizenship and Immigration Services (USCIS), has alerted employers to an email phishing scam requesting Form I-9 information. Recently, some employers have received fraudulent emails requesting Form I-9 information. These emails appear to be from USCIS; they are not. USCIS advises that you do not respond to these emails or click the links in them.
Employers are not required to submit Forms I-9 to USCIS. In fact, employers do not provide the government with the Form I-9 unless they are the subject of a worksite enforcement investigation by Immigration and Customs Enforcement (ICE). Employers must retain Forms I-9 for all current employees and terminated employees until retention requirements have been met. Once an employee is terminated, their I-9 needs to be kept for three years from the date of hire or one year after termination, whichever is later.
